5. Legal Bases for Processing (GDPR / UK GDPR)

If you are in the European Economic Area or the United Kingdom, we rely on the following legal bases under Article 6 of the GDPR (and the equivalent UK GDPR provisions):

  • Consent — for non-essential cookies and similar technologies (Analytics and Marketing), and for any optional marketing communications. You may withdraw consent at any time.
  • Legitimate interests — to operate and secure our website, respond to enquiries, understand our audience, and promote our services, where these interests are not overridden by your rights and freedoms.
  • Performance of a contract — to take steps at your request before entering into a contract and to deliver the services you ask us about.
  • Legal obligation — where we must process your information to comply with applicable law.

6. Sharing & Third Parties

We share personal information only as needed to operate our business and website. We may disclose information to:

  • Advertising and analytics providers — Meta Platforms, Inc. (Meta/Facebook Pixel) and Google LLC (Google Analytics 4 and Google Ads), where you have consented to the relevant cookie categories.
  • Email and communications providers — the email delivery service we use to receive and respond to your enquiries.
  • Hosting, infrastructure, and file storage providers — our website hosting platform and our cloud file/blob storage provider, which process data on our behalf.
  • Professional advisors and authorities — legal, accounting, and regulatory bodies where required to comply with law or protect our rights.
  • Successors — a buyer or successor in the event of a merger, acquisition, or sale of assets.

Our service providers are permitted to use your information only to provide services to us and in line with this policy and applicable law.

7. International Data Transfers

We operate in the Caribbean and work with service providers that may store or process information in other countries, including the United States and other regions. These countries may have data protection laws that differ from those where you live. Where we transfer personal information across borders, we rely on appropriate safeguards where required, such as the European Commission's Standard Contractual Clauses, the UK International Data Transfer Agreement or Addendum, or other lawful transfer mechanisms.

8. Data Retention

We keep personal information only for as long as necessary for the purposes described in this policy, including to respond to your enquiry, maintain business and legal records, and resolve disputes. Contact form submissions are generally retained for up to three (3) years from your last interaction with us, unless a longer period is required by law. Cookie and tracking data is retained according to the retention settings of the relevant tool and your consent choices. When information is no longer needed, we delete it or anonymize it.

9. Your Privacy Rights

9.1 GDPR / UK GDPR (EEA & United Kingdom)

Subject to applicable law, you have the right to:

  • Access the personal information we hold about you
  • Request rectification of inaccurate or incomplete data
  • Request erasure of your personal information
  • Request restriction of processing
  • Receive your data in a portable format (data portability)
  • Object to processing based on legitimate interests

If you are a California resident, you have the right to:

  • Know what personal information we collect, use, and disclose
  • Request deletion of your personal information
  • Request correction of inaccurate personal information
  • Opt out of the "sale" or "sharing" of personal information
  • Limit the use of sensitive personal information, where applicable
  • Not receive discriminatory treatment for exercising your rights

We honor opt-out preference signals, including the Global Privacy Control (GPC), as a valid request to opt out of the sale or sharing of personal information for the browser or device on which it is enabled.

9.3 Canada (PIPEDA)

If you are in Canada, the Personal Information Protection and Electronic Documents Act (PIPEDA) gives you the right to access the personal information we hold about you, to request correction of that information, and to withdraw consent (subject to legal or contractual limits). You may also direct a complaint to the Office of the Privacy Commissioner of Canada.

To exercise any of these rights, contact us at info@islandtanksolutions.com. We will respond within the timeframes required by applicable law. We may need to verify your identity before acting on your request, and you may use an authorized agent where the law permits.

10. How to Manage Your Cookie Choices

When you first visit our website, our cookie banner lets you accept or reject the Analytics and Marketing categories. Necessary cookies are always active because the site cannot work without them.

You can change your choices at any time using the “Cookie Preferences” control in the footer of every page. You can also manage or delete cookies through your browser settings, and you can opt out of certain advertising via your browser's Global Privacy Control signal where supported. Disabling some cookies may affect how parts of the site function.

11. Children's Privacy

Our website is intended for a business and professional audience and is not directed to children. We do not knowingly collect personal information from anyone under the age of 16. If you believe a child has provided us with personal information, please contact us and we will take steps to delete it.

12. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, or legal requirements. When we do, we will revise the effective date and version reference at the top of this page. Material changes will be highlighted where appropriate. We encourage you to review this policy periodically.
